These Terms of Service ("Terms") govern your access to and use of the Barood mobile application and website (collectively, the "Service") provided by Barood ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use Barood.
1. Eligibility
You must be at least 13 years old to use Barood. By using the Service you represent that you meet this requirement. If you are between 13 and 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
2. Your Account
- You are responsible for maintaining the confidentiality of your password and for all activity under your account.
- You must provide accurate information when creating your account and keep it up to date.
- You may not share your account with others or create multiple accounts to circumvent restrictions.
- Notify us immediately at baroodfitness@gmail.com if you suspect unauthorised access to your account.
3. Acceptable Use
You agree not to:
- Use Barood for any unlawful purpose or in violation of any applicable law
- Upload or share content that is abusive, harassing, defamatory, obscene, or that infringes any third-party intellectual property rights
- Attempt to reverse-engineer, decompile, or extract source code from the app
- Use automated bots, scrapers, or scripts to access or manipulate the Service
- Manipulate leaderboards, XP systems, or challenge results through artificial means
- Impersonate another person or misrepresent your affiliation with any organisation
- Interfere with or disrupt the integrity or performance of the Service
4. Barood Premium
Subscription Plans
Barood offers a Premium subscription ("Barood Premium") that unlocks additional features including advanced analytics, exclusive programs, AI-powered tools, and more. Plans and pricing are displayed in-app and on our website.
Free Trial
New users may be offered a 3-day free trial of Barood Premium. If you do not cancel before the trial period ends, your account will automatically be charged the applicable subscription price.
Billing & Renewal
- Subscriptions purchased through the Apple App Store or Google Play Store are billed and managed by Apple or Google respectively. Their billing terms apply.
- bKash subscriptions are managed manually via our WhatsApp support channel and are billed monthly.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
Refunds
Refunds for App Store and Play Store purchases are governed by Apple's and Google's refund policies. For bKash payments, contact us within 48 hours of payment if you believe an error has occurred.
Cancellation
You may cancel your Premium subscription at any time through your App Store or Play Store account settings, or by contacting us for bKash subscriptions. Access continues until the end of the paid period.
5. Pro Trainer Programs
Barood hosts workout programs created by verified Pro Trainers. These programs are provided for informational and educational purposes only. Barood does not independently verify the medical accuracy of trainer-provided content. Always consult a qualified healthcare professional before starting any new exercise or nutrition program, especially if you have a medical condition or injury.
Program availability is subject to the trainer maintaining their Barood partnership. We do not guarantee continuous availability of any specific program.
6. AI Calorie Camera
The AI Calorie Camera feature uses artificial intelligence to estimate the nutritional content of food from photos. These estimates are approximations and may not be accurate for all foods, preparation methods, or portion sizes. Do not use this feature as a substitute for professional dietary advice.
7. Health Disclaimer
Barood provides fitness tracking tools, workout programs, and nutritional information for general wellness purposes. The Service is not a medical device and does not provide medical advice, diagnosis, or treatment. Always seek the advice of a qualified physician or other healthcare provider with questions you may have regarding a medical condition.
8. Intellectual Property
All content, design, code, trademarks, and other materials on Barood are the property of Barood or our licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
You retain ownership of content you create within Barood (e.g., notes, custom workouts). By uploading content, you grant us a non-exclusive, royalty-free licence to display and deliver that content as part of the Service.
9. Third-Party Services
Barood integrates with third-party services such as Apple, Google, and payment processors. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.
10. Corporate & Business Accounts
Organisations that set up Barood corporate workspaces ("Barood for Org") must designate an administrator who agrees to these Terms on behalf of the organisation. The organisation is responsible for ensuring all users within their workspace comply with these Terms. Corporate pricing and features are subject to a separate agreement.
11. Termination
We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, at our sole discretion, to be harmful to the Service or other users. You may delete your account at any time via Settings. Termination does not entitle you to a refund except as required by law.
12. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, Barood shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.
13. Changes to These Terms
We may update these Terms as Barood evolves. When we make material changes, we will notify you via an in-app notification and update the "Last updated" date. Continued use of Barood after the effective date constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of Bangladesh. Any disputes shall be resolved in the courts of Dhaka, Bangladesh, unless otherwise required by applicable consumer protection law in your jurisdiction.
